Description:As a part of the hiring process, employers often check an applicant’s criminal history. In some contexts and for some positions, employers are legally required to do so. For example, the California Education Code mandates criminal background checks. This is because the Code prohibits employment of people convicted of certain specified crimes; but other convictions may be weighed by the school district when making a hiring decision. Dealing with the collection and consideration of criminal history records in the hiring process can be challenging. This webinar will help you understand when criminal background checks are required, California’s “Ban the Box” law, and the legal restrictions on accessing and using criminal history records.

Melanie Chaney litigates employment cases involving claims such as harassment, discrimination, retaliation and wage and hour claims and represents public agencies in disciplinary actions and grievances. She has successfully handled matters before administrative bodies such as the Office of Administrative Hearings, Labor Commissioner, Equal Employment Opportunity Commission, and the Department of Fair Employment and Housing. She also conducts and assists with workplace investigations and provides advice on creating and updating public agency personnel procedures and policies.
